1. Purpose and scope

These Terms of Use (the “Terms”) set out the rules governing access to and use of appergo.com, its different language versions, and any online tools, software, files, content, resources, information and forms that may be made available through the website.

AppErgo is an independent project developed and published in France. Depending on their nature, the services and materials offered may be practical, informational, technical, editorial or experimental.

2. Publisher and contact

The website is published on a personal basis as part of the AppErgo project.

3. Language versions and translations

AppErgo is available in ten languages: French, English, German, Spanish, Italian, Portuguese, Russian, Japanese, Chinese and Korean.

French and English are the website’s two main editorial versions. The other eight versions are primarily focused on online tools, their categories, favourites and the main information pages. Some articles, news, software, projects, Forge pages or other editorial material may therefore remain available only in French or English.

Translations may be produced with the assistance of translation and artificial-intelligence tools and then reviewed and adjusted as far as possible. Despite this work, an imperfect translation, wording difference or ambiguity may remain. A translated version does not change the nature of the original material, its authorship, any licence applying to it or the obligations attached to it.

4. Acceptance of the Terms

Accessing and using the website implies acceptance of these Terms. Users are encouraged to read them before using a tool, submitting a form, downloading a file or using software offered through AppErgo.

If a user does not accept these conditions, they should not use the relevant services.

5. Access, availability and website changes

Access to AppErgo is provided subject to possible interruptions, maintenance, technical limitations, security incidents or circumstances outside the publisher’s control. Permanent, error-free availability cannot be guaranteed.

The publisher may modify, suspend, move, replace or remove all or part of any content, tool or feature when necessary for maintenance, security, problem correction or the development of the project.

URLs, categories, supported languages and the internal organisation of the website may also evolve over time.

6. Content and services

AppErgo may provide, among other things:

• free online tools available directly in a web browser;
• categories, favourites and features that make tools easier to access;
• articles, news and other editorial content;
• software, files and resources offered for download;
• information about software or experimental projects;
• development, testing or evaluation builds;
• contact and bug-report forms;
• technical, documentary or informational resources.

The availability of a type of content in one language version does not guarantee that it is available in every other language.

7. Online tools and local processing

AppErgo online tools are provided free of charge and without requiring an account. They may be changed at any time to improve their features, usability, performance, accessibility or compatibility.

Unless otherwise clearly stated to the user, the tools are designed to perform their calculations, conversions, transformations or generations directly in the browser. Where processing is local, the data entered into the tool is not sent to the AppErgo server to produce the result.

A result may nevertheless be incomplete, unexpected or incorrect. Users remain responsible for checking it before relying on it, particularly in professional, administrative, legal, medical, financial, scientific or technical contexts.

The publisher does not guarantee that any tool or result will be suitable for every use, system, browser, device or particular situation.

8. Software, Forge and development builds

AppErgo may provide downloadable software or files as well as projects that are still under development. Where specific terms or a particular licence apply to software or a file, they are identified with the relevant item.

Versions identified as alpha, beta, release candidate, test build or similar may contain bugs, limitations, incompatibilities or incomplete features. They are primarily made available for testing, evaluation and feedback.

Before installing or using software, users should determine whether it is suitable for their needs and take appropriate precautions to protect their system, data and backups.

9. User obligations

Users agree to use AppErgo fairly, lawfully and in accordance with the intended purpose of the services provided.

In particular, users must not:

• use the website, tools or forms for fraudulent, abusive or unlawful purposes;
• disrupt or attempt to disrupt the operation, security or availability of the website;
• bypass or attempt to bypass security or access-control measures;
• use forms to send spam, malicious material or manifestly abusive messages;
• attempt to access website data, services or infrastructure without authorisation;
• misuse a tool or service in a way that may harm the website, the publisher or third parties.

10. Contact, bug reports and contributions

Contact and bug-report forms may be used to submit questions, observations, technical information, suggestions or feedback. Users should limit submitted information to what is useful for processing their request.

The publisher may choose not to respond to messages that are clearly automated, abusive, irrelevant, unintelligible or unlawful.

A suggestion or idea submitted voluntarily does not require AppErgo to implement it, pay for it or maintain a corresponding feature. Where users submit material they did not create themselves, they are responsible for ensuring that they are authorised to do so.

11. Intellectual property, licences and results

Unless otherwise stated, AppErgo’s texts, interfaces, visuals, logos, illustrations, structure, templates, scripts, internal components, software and other original materials remain protected by applicable law.

Some software, libraries, files or resources may be distributed under a specific licence, including free or open-source licences. In that case, the terms of that licence apply to the relevant item and take precedence over any incompatible general provision.

Results produced by AppErgo tools may be copied and reused freely unless they themselves incorporate content, data or material subject to third-party rights. When publicly reusing a result, method or AppErgo page, a link to the relevant page is appreciated.

The free reuse of a generated result does not constitute general permission to reproduce the website’s protected texts, interfaces, scripts, templates, illustrations or other materials.

12. External links, content and third-party services

AppErgo may contain links or integrations pointing to websites, platforms, videos, services, libraries or resources operated by third parties.

Those services have their own terms, privacy policies, rules and practices. AppErgo does not control all of their content and cannot guarantee their availability, security, accuracy or continued operation.

13. Personal data

The rules concerning personal data, forms, technical logs, local processing within tools and any measurement or storage technologies are described in the Privacy Policy.

Contact and bug-report forms are separate from tools that operate locally: information voluntarily submitted through those forms must be transmitted to the server so that the message can be received and processed.

14. Audience measurement, local storage and similar technologies

The website may use technical logs, audience statistics or local-storage mechanisms needed for its operation, the storage of certain preferences, security, abuse prevention or service improvement.

Where the use of a cookie, identifier or similar technology requires specific information or consent under applicable law, the relevant measures must be implemented. The technologies actually used are described in the Privacy Policy.

15. Liability

The publisher makes reasonable efforts to provide tools, information and software that are as reliable as possible, but does not guarantee completeness, permanent accuracy, suitability for a particular purpose or the complete absence of bugs or errors.

Use of the website, tools, results, information and software is the user’s responsibility. Users should keep appropriate backups and verify results where an error could have significant consequences.

To the extent permitted by applicable law, the publisher shall not be liable for direct or indirect damage resulting in particular from access to the website or inability to access it, use of a tool or result, incompatibility, data loss, downloads, technical interruption or use of a service in a manner inconsistent with its intended purpose.

The applicable version is the one published on the website when the user consults it. Where appropriate, a substantial change may be specifically highlighted on the website.

17. Governing law

These Terms are governed by French law, without prejudice to any mandatory provisions that may apply to users depending on their circumstances or place of residence.
